About the speaker:

Toby Lewis joined WSP in 2015, after 23 years working in environmental health and part-time consultancy. His local authority work encompassed all aspects of environmental protection but became increasingly focused on noise in the planning, licensing and statutory nuisance regimes.

Toby’s clients include central and local government, all sorts of developers, industrial and commercial operators, entertainment venues, complainants and objectors. Anyone really. He particularly enjoys expert witness roles involving technical or legal argument.

He is a member of several industry groups and committees and has published work on wind turbine noise regulation, planning, nuisance, entertainment noise and industrial noise. He is a Chartered Fellow of the CIEH and a Fellow of the IoA.

About the talk:

The concept of noise nuisance is poorly understood by many acousticians, who often have a tendency to focus on sound levels in their assessments. In fact, sound levels are just one of several key factors established by the Courts to be material in a nuisance determination. A balanced assessment needs to weigh all of those elements, based on the available evidence, in a manner proportionate to the particular circumstances of the case.

The joint expert instruction arose following a Court direction to the recipient of an Abatement Notice (the appellant) and the enforcing local authority (the defendant) to jointly instruct an independent expert to provide an unbiased opinion of the potential continuation of the alleged noise nuisance. This presentation will explain how the independent investigation and assessment was carried out.
